Last Will and Testament of William Henry Forsyth

In the name of God Amen I William Henry Forsyth of the town of Chili Hancock County state of Illinois of the age of twenty six years and being of sound mind and memory do make publish and declare this my Last Will and Testament in manner following that is to say

First I give and bequeath to my wife Martha Lurinda Forsyth the sum of one thousand dollars Provided that she does not claim her legal dower in my real estate

Second I give and device to my three children To Wit Alpha Layson Forsyth, Joel M. Forsyth and William M. Forsyth my real estate to be equally divided among their said estate being the West Half of the North east quarter of section thirty two in township three (3) north of Base Line in Range six West of the fourth principal meridian in Hancock County state of Illinois

The rest of said farm to be used for the support and education of my three children during their minority. The remainder of my estate (after my just debts are paid) to be equally divided amond [sic] my three children to put an interest until said children need it for their support or education at the discretion of the administrator

I hereby appoint Alpha Forsyth my sole executor. In witness thereof I have hereunto set my hand and seal this twenty ninth day of April in the year of our Lor[d] one thousand eight hundred and seventy one.

Petition of Alpha Forsythe in the matter of the last Will and Testament of William Henry Forsythe deceased, for Probate of Will and Letters Testamentary.

The the Hon. Jos Ripe Judge of the County Court of Hancock County, in the State of Illinois.

The petition of the undersigned Alpha Forsythe repectfully represents that William Henry Forsythe late of the County of Hancock aforesaid, departed this life at his residence in said County, on or about the Eleventh day of May A. D. 1871 leaving a last Will and Testament, duly signed published and attested as believed by your petitioner and which by Petinoner is herewith presented to your honor for Probate. That said Will is subscribed by William H. Leach and William M Willard as witnesses to the execution thereof.

That said testator in & by said last Will nominated and appointed Alpha Forsythe your Petitioner Executor thereof, and that your petitioner is willing and ready to accept and undertake the office and trust confided to him.

And this Petition further shows that the said William Henry Forsyth died seized and possessed of Real and Personal Estate consisting chiefly of Eighty acres of Land & personal property & Monies all of said personal estate being estimated to be worth about Two Thousand dollars.

In consideration whereof, and to the end that said Will may be proved, established and performed, your Petitioner pray that the subscribing witnesses aforesaid may be summoned to be and appear before this Court at the next Term Term [sic] thereof, then and there to testify in the matter of said Will, as it may please your honor to direct; and that Probate of said Will may be thereupin granted, and the same ordered for record.

And you Petitioner further pray that it may please your honor to grant petitioner Letters Testamentary of said Will and Testament, upon this taking the Oath prescribed by the Statue and entering into bond such sum and with such securities as my be approved by your honor.

On Friday the Nineteenth day of May A. D. 1871

1. And now, on this day, in said Court, come Alpha Forsyth and duly files his Petition to the Judge of said Court, in Probate, representing that Alpha L Forsyth is a minor aged [blank] years on the [blank] day of [blank] AD 187[] that Joel M Forsyth is a minor aged [blank] years on the [blank] day of [blank] AD 187[] that Wm M Forsyth is a minor aged [blank] years on the [blank] day of [blank] AD 187[]. that said widow are residents of this County; that they have no father living or other legal Guardian residing in theis State; that said minors have an interest in the estate of their father amounting to about Two thousand dollars and that your petitioner is Grand father of and desires he may be appointed guardian of said minors and said Petition being read and considered by the Court, it is thereupon ordered that the said petition be filed, and the prayer thereof be granted, provided the said Alpha Forsyth first files his Bond in the penal sum of Six Thousand Dollars, with security or securities therein, to the approval and acceptance of this Court.

2. Pursuant to the foregoing order, the said Alpha Forsyth comes and presents his Bond in the pernal sum of Six Thousand Dollars, signed and sealed by himself as principal, and by Daniel Witt and Apollo Shriver as securities, and said Bond being read and considered by the Court, and appearing to be in due form of law, and the security therein being deemed sufficient and satisfactory, it is thereupon ordered that the same be and is hereby approved, and that the Clerk file and record the same, and that the said Alpha Forsyth be and is hereby appointed Guardian as aforesaid, and that the Clerk issue letters of Guardianship accordingly, under his hand and the Probate Seal of this Court, and file and record the same.

Know all men by these Presents, that we Alpha Forsyth as principal and Daniel Witt and Apollo Shriver as securities of the County of Hancock and State of Illinois, as held and firmly bound unto the people of the State of illinois, for the use of Alpha L Forsyth, Joel M Forsyth and Wm M Forsyth in the penal sum of Six Thousand Dollars, current money of the United States, which payment, well and truly to be made and performed, we and each of us bind ourselves, our heirs, executors and administrators and assings,, jointly, severally, and firmly by these presents. Witness our hands and seals, this 23rd day of May A.D. 1871

The Condition of the above Obligation is such, That if the above bounden Alpha Forsyth who has been appointed Guardianfor Alpha L Forsyth, Joel M Forsyth, and Wm M Forsyth shall faithfully discharge the office and trust of such Guardian, according to law, and shall render a fair and just account of his Guardianship, to the County Court of the County of Hancock from time to time, he shall be thereunto required by said Court, and comply with all the orders of said Court, lawfully made, relative to the goods, chattels and moneys of such minors and render and pay to such minors all moneys, goods and chattels, title papers and effects, which may come to the hands and possession of such Guardian belonging to such minors when such minors shall be thereunto entitled, or to any subsequent Guardian should such Court so direct, then this obligation shall be void; otherwise to remain in full force and virtue.

Trusting in your fidelity, therefore, the said Court doth by these presents constitute and appoint you to be Guardian unto said minors and authorize and empower you to take and to have the care of their persons and the custody and management of their property, frugally and without waste or destruction to improve and account for the same in all things according to law.

The People of the State of Illinois, to all to whom these Presents shall come, Greeting:
Know ye, That whereas William H Forsyth late of the County of Hancock and State of Illinois, died on or about the Eleventh day of May A.D. 1871 as it is said, after having duly made and published his last Will and Testament, a copy whereof is hereunto annexed, leaving at the time of his death, property in this State, which may be lost, destroyed, or diminished in value, if speedy care be not taken of the same; and, inasmuch as it appears that Alpha Forsyth has been appointed Executor in and by the last Will and Testament to execute the same:

Now, to the end that the said property may be preserved for those who shall appear to have a legal right or interest therein, and that the said Will may be executed according to the request of the testator we do hereby authorize the said Alpha Forsyth as such Executor to collect and secure all and singular the goods and chattels, rights and credits, which were of the said William H Forsyth at the time of his decease, in whose ever hands or possession the same may be found in this State; and well and truly to perform and fulfill all such duties as may be enjoined upon him by the said Will, so far as there shall be property, and the law charge him and in general to do, and perform all other acts which now are, or hereafter may be required, of him by law.

1. And now, on this day, in said Court, come Alpha Forsyth and duly files his Petition to the Judge of said Court, in Probate, representing that on Thursday the Eleventh day of May A.D. 1871 William Henry Forsyth late of the town of -- in the County of Hancock and State of Illinois, departed this life, Testate, leaving a Last Will, and Testament. That said Will is subscribed by William H. Leach and William M. Willard as witnesses to the execution thereof, that said testator in and by said last will nominated and appointed Alpha Forsyth your petitioner Executor thereof and that your petitioner is willing and ready to execute and undertake the office and such confided to him. And this petitioner further shows that the said William Henry Forsyth died siezed and possessed of Real and personal estate consisting chiefly of Eighty acres of Land and Personal property and survives all of and personal estate being estimated to be worth about Two Thousand Dollars. which petition is duly sworn to be said Petitioner, Alpha Forsyth And it is thereupon ordered that the same be filed by the Clerk of this Court.

2. It being duly proved to the Court that William Henry Forsyth named in the foregoing order as having deceased, has departed this life, and no person having appeared to oppose the granting of Letterts Testamentory to the said Alpha Forsyth or to show cause why the payer of said petition should not be allowed, it is ordered that the same be and is hereby granted, provided the said Alpha Forsyth first give bond as such Executor in the form required by law, in the penal sum of Four Thousand Dollarsa, with security and securities therein, to the acceptance and approval of the Court.

3. Pursuant to the last foregoing order, the said Alpha Forsyth comes and presents his bond as Executor as aforesaid, in the pernal sum of Four Thousand Dollars, signed and sealed by himself as principal, and by Daniel Witt and Apollo Shriver as securities and said bond appearing to be in due form of law, and the security therein deemed being sufficient and satisfactory, it is thereupon ordered that the same be and is hereby approved and accepted.

4. The said Alpha Forsyth then before said Court, took and subscribed an oath of Office in the form required by law, and attached the said Will, well and truly execute the same, etc., as follows:

I do solemnly swear That this writing contains the true last Will and Testament of the within named William Henry Forsyth deceased, so far as I know or believe; and that I will well and truly execute the same, by paying first the debts and then the legacies mentioned therein, as far as his goods and chattels will thereto extend, and the law charge me; and that I will make a true and perfect inventory of all such goods and chattels, rights and credits, as may come to my hands or knowledge, belonging to the estate of said deceased, and render a fair and just account of my Executorship, when thereunto required by law, to the best of my knowledge and abilities; so help me God.

This is to inform you, jointly, to appraise the goods, chattels and personal estate of William Henry Forsyth late of the County of Hancock and State of Illinois, deceased, so far as the same shall come to your sight and knowledge, each of you having first taken the oaths hereunto annexed; a certificate whereof you are to return, annexed to an Appraisement Bill of said goods, chattels and personal estate, by you appraised in dollars and cents; and in the said bill of appraisement you are to set down in a column or columns, opposite to each article appraised, the value thereof.
