  • Text: Pleas at Xenia before the Honorable Benjamin Hinkson president and Saml Kyle, Simeon Dunn and Daniel Martin his associate Judges of the Court of Common pleas within and for the County of Greene and state of Ohio on the thirty first day of August in the year of Our Lord One thousand eight hundred and forty one

    The Heirs of James McFarland

    Be it remembered that heretofore to wit, on the fourth day of September in the year of Our Lord One thousand eight hundred and forty said Complaintant by Harlan and Galloway his solicitors filed in the Court of Common pleas of the County aforesaid the following bill in chancery to wit: To the Honorable Judges of the Court of Common pleas of the County of Greene and the State of Ohio in chancery none sitting. Your petitioner Uriah Lawrence and Thirza his wife late Then a McFarland and one of the sisters of James McFarland late of the County of Green aforesaid and who departed this life in the month of May in the year of Our Lord eighteen hundred and twenty-nine. That said James McFarland died seized and possessed in fee simple of the follwing ... That said James McFarland died intestate leaving neither Widow or children but left surviving him the following brothers and sisters his heirs at Law to wit: Robert McFarland, Priscilla McFarland, Martha McFarland, Margaret Newport, Polly Brewer the wife of Aaron Brewer, Tabitha White the wife of John White Catherine McFarland the wife of John W. McFarland, John McFarland since deceased, Joseph McFarland since deceased, Arthur McFarland since deceased, Benjamin McFarland, and your petitioner Thirza ... The said Joseph McFarland died intestate leaving a widow Rebecca McFarland and as your petitioners are informed and believes several children whose names ages and residence is unknown to your petitoners. That said Arthur McFarland deceased died intestate leaving a widow Jane McFarland and the following children and heirs as follows. Green C. McFarland Eliza McFarland and the wife of William McFarland. Sophronia Smith wife of John Smith. Lucinda Smith the wife of Joseph Smith Jesse N. McFarland Rachel McFarland all of full age and the following who are minors to wit: Mary Jane McFarland Matilda McFarland Margaret McFarland Martha McFarland. This said John McFarland died intestate leaving a widow Rebecca McFarland and the following heirs and children to wit: William McFarland Joseph H. McFarland Rebecca Willard wife of John Willard and Margaret J. McFarland all of full age and the following who are minors to wit: Emily McFarland Priscilla A. McFarland Doctor B McFarland Robert V McFarland Catherine E McFarland Daniel G McFarland and Francis C. McFarland. Your petitioner states that said Robert McFarland Priscilla McFarland Martha McFarland Margaret Newport Green C. McFarland Sophronia Smith and John Smith her husband Lucinda Smith and Joseph Smith her husband John White and Tabitha his wife Jane McFarland Jesse N. McFarland Rachel McFarland Mary J. McFarland Matilda McFarland Margaret McFarland and Martha McFarland reside in the county of Greene and State of Ohioand all the other defendants reside out of this state. ...

    The following is a copy of exhibit A, referred to in the foregoing bill and made a part of the same to wit: "Know all men by these presents that we John W. McFarland and Catherine his wife Robert McFarland Aaron Brewer and Polly his wife John McFarland Joseph McFarland Jr. Margaret Newport Benjamin McFarland John White and Tabitha his wife Martha McFarland and Priscilla McFarland being the brothers and sisters and heirs at law to James McFarland late of Greene County and State of Ohio dec'd are held and firmly bound unto Uriah Lawrence of the County and stae aforesaid in the penial sum of nine hundred dollars lawful money of the United States for the payment of which we bound Ourselves Our heirs, executor and administrator and every of them jointly and severally by these presents as witness our hands and seals this fourth day of February 1836.
