In the matter of the Estate of Alpha Forsyth deceased

The the Honorable John D. Miler Judge of the County Court of Hancock County, in the State of Illinois.

The Petition of the undersigned Priscilla Forsyth repectfully represents, that Alpha Forsyth late of the County of Hancock aforesaid, departed this life at his home in said County, on or about the 4th day of September A. D. 1891 leaving no last will and testament so far as your petitioner know or believe

And this Petition further shows, that the said Alpha Forsyth died seized and possessed of Real and Personal Estate consisting chiefly of farming and other lands and town property, live stock farming implements, household goods, notes and accounts and money in bank all of said personal estate being estimated to be worth about Six thousand Dollars. That said deceased left surviing him your petitioner Priscilla Forsyth his widow and Nancy Worrell wife of William Worrell, & Mary A. Lanstrum widow his children and Joel Forsyth and William Forsyth children and only heirs of William Forsyth as deceased son of said Alpha Forsyth as heirs. That your petitioner (being the widow of said deceased,) and believing that the said estate should be immediately administered as well for the proper management of said estate as for the prompt collection of assets, by virtue of her right under the Statute, therefore prays that your honor will grant letters of Administration to her and Cornelius B. Taylor her nephew in the premises upon their taking the oarth prescribed by the Statute and entering into Bond in such sum, and with securities, as may be approved by your Honor.

The People of the State of Illinois, to all to whom these Presents shall come, Greeting:

Know ye, That, whereas, Alpha Forsyth of the County of Hancock and State of Illinois, died intestate, as it is said, on or about the fourth day of September A.D. 1891, having at the time of his decease, personal property in this State, which may be lost, destroyed, or diminished in value, if speedy care be not taken of the same.

To the end, therefore, That the said property may be collected and preserved for those who shall appear to have a legal right or interest therein, we do hereby appoint Priscilla Forsyth and Cornelius B. Taylor of the County of Hancock and State of Illinois, administrators of all and singluar the goods and chattels, rights and credits, which were of the said Alpha Forsyth at the time of his decease; with full power and authority to secure and collect the said property and debts, wheresoever the same may be found in this State, and in general to do and perform all orther acts which now are, or hereafter may be required of him by law.

Order Authorizing Sale of Property at Private Sale (typed copy)

In the matter of the estate of Alpha Forsyth, deceased:

And now on this day came Priscilla Forsyth and Cornelius B. Taylor administrators os the estate of said deceased, by O'Harra, Scofield & Hertzell their attorneys, and also come Nancy E. Worrell and others, heirs at law of said deceased, by Mack & Son their attorneys; and said heirs by their attorneys present and file their petition, praying that certain chattel property therein mentioned be directed to be sold at private sale, and thereupon ask that the order of sale granted on October 3.1891, be modified so that said chattel property mentioned in the petition filed this day, may be sold at private sale; and the hearing of said petition now coming on, and no objection being made, on consideration, it is order by the court, with the consent of the attoryneys of the respective parties, that the order aforesaid of October third, be modified so that said administrators in their discretion may sell at private sale, the chattel property mentioned in the petion filed this day, except such part, if any, as the widow may select upon her award the same to be sold at a price not less than the appraisement thereof, and for cash in hand, and if the same are not disposed of, or such part thereof on hand at the time fixed for the public sale, then that at such sale the property not disposed of at private sale be sold at the public sale. That proper report of all sales be made, and that said petition be recorded.

W. chamber 7 Table spreads, 12 Towels, parlor curtains, knives & forks carpet in middle chamber and about 2600 bushels of wheat are embraced in the inventory and appraisement bill & said estate and some of them are family relics and they and said wheat so your petitioners belive will sell better at private sale that it is necessary for the proper administration of said estate that the same be sold, and that it will be to the best interest of said estate that they be sold at private sale.

Your petitioners therefore respectfully pray for an order of this Court directing the administrators to sell personal property at private sale and that any part thereof not sold at private sale may be sold at the public sale now advertised

To the Hon. John D. Miller Judge of said Court:

The petitioners Nancy Worrell, Mary A Lanstrum daughters of Alpha Forsyth and Joel Forsyth and William Forsyth grandsons of said Alpha Forsyth and only sons & children of William Forsyth deceased a son of said Alpha Forsyth respectfully represent that they ar the only heirs and distributees of the estate of said Alpha Forsyth deceased. Your petitioners further represent and shew to the court that Priscilla Forsyth widow of said Alpha Forsyth before their marriage on to wit on or about 19th day of August AD 1886 entered into what is commonly known as an antenuptial contract duly executed signed and sealed by them wherein the said Priscilla Forsyth by the name of Priscilla Carrier which was her name before her marriage with said Alpha Forsyth for the consideration of certain real estate therein described and the further consideration of Five hundred Dollars to be paid to her after the death of said Alpha Forsyth covenanted and agreed to release and did release and all claims rights and interest she might become entitled to as the wife and widow of said Alpha Forsyth to any of his estate real or personal including what is commonly known as the widow's award and also the right of dower and all interest whatever to which she might have become entitled had not said antenuptial contract been made and executed by her said Priscilla Carrier (now Forsyth) and said Alpha Forsyth. That said antenuptial contract remains in full force, and by reason and force thereof said Priscilla Forsythe is not entitled to any award or widow's set off out of the estate of said Alpha Forsyth nor any dower nor other interest in his real or personal estate.

Your petitioners therefore pray that the appraisers to be appointed to appraise the goods chattels belonging to said estate be directed by the order of this court not to make nor to certify to this court any estimate of the value of articles of specific property usually allowed.

Worrell and others heirs at law of Alpha Forsyth and filed in this court their petition praying the court for an order directing the appraisers of the personal property of the estate of said Alpha Forsyth deceased not to be made nor certify to this court any estimate of the value of articles of specific usually allowed by law to the widow alledging in said petion that Priscilla Forsyth widow of said Alpha Forsyth is not entitled to any widow's award out of said estate and therefore it is ordered by the court by the consent of the parties that the hearing of said petition and the matters therein set forth do set for Wednesday the 23rd Sept 1891

Now on this day came Nancy Worrell, Mary A. Lanstrum, Joel Forsyth, and William Forsyth, petitioners, by Messers Mack & Son their attorneys, - came also Cornelius B. Taylor and Precilla Forsyth administrators of the estate of said deceased, and also the said Precilla Forsyth widow of said deceased, by Messers O'Harra, Scofield and Hartzell their attorneys, and petitioners having on September 19.1891, filed there petition herein, praying that the appraisers of the estate be instructed not to make nor to certify to this court any estimate of the value of specific articles usually allowed by law to the widow, called the "widow's award," and the same having been set for hearing on this day, - and thereupon, the parties submitted their evidence, and the court having hear the arguments, of counsel; - thereupon, by leave of the court, said petitioners now here dismiss their said petition, without prejudice in the premises to either of the parties. It is therefore ordered by the Court, that the costs attending this petitoon be paid by the petitioners, and that fee bill, according to the usual practice issue for such costs, if the same are not paid within thirty days.

This is to Authorize You, jointly, to appraise the goods, chattels and personal estate of Alpha Forsyth late of the County of Hancock and State of Illinois, deceased, so far as the same shall come to your sight and knowledge, each of you having first taken the oath hereunto annexed; a certificate whereof you are to return, annexed to an appraisement bill of said goods, chattels and personal estate, by you appraised in dollars and cents; and in the said bill of appraisement you are to set down in a column or columns, opposite to each article appraised, the value thereof.

The undersigned, Priscilla Forsyth & Cornelius B. Taylor your petitioners by appointment of this Court, administrators of the Estate of Alpha Forsythe deceased, respectfully represent that they have heretofore duly returned to this Court the inventory and appraisement of the personal estate of said deceased; that it is necessary for the proper administration of said estate that all the personal property of said deceased as shown by the appraisement Bill filed in this cause (except such articles as may be taken by the widow on her Widows award) be sold by our petitioners herein and that it will be to the best interest of said estate that they be sold at Public sale.

Your petitioners therefore respectfully pray for an order of this Court directing them to sell said personal property at Public sale at the late residence of said deceased Alpha Forsythe on Thursday, October 29th 1891 and to continue from day to day until said property os disposed of at Public Auction.

In the Matter of the Estate of Alpha Forsyth Deceased.

And now on this day comes Priscilla Forsyth & Cornelius B. Taylor, administrators of the estate of said deceased, and present them verified petition for the sale of the goods and chattels of said deceased. And it appearing to the Court that the inventory and appraisement of said estate have been heretofore filed and approved in this Court, the Court proceeds to consider said petition. And the Court having ascertained that there has been filed in the matter of said estate "The Widow's award" to which award Nancy E Worrell and others heirs of Alpha Forsyth have filed objections to be heard hereafter and this order does not determine any thing in regard to said award or her right thereto and that a sale of the goods and chattels of said estate is, necessary to the proper administration of said estate, it is thereupon ordered by the Court that the said Priscilla Forsyth & Cornelius B. Taylor administrators as aforesaid, proceed, according to law, to advertise and sell all the personal property, goods and chattels mentioned in the inventory and appraisement bill of said estate, except such articles as the widow may select on her "widows award", which said sale shall be at the late residence of said deceased, Alpha Forsythe, and shall be at public sale, on the 27th day of October A.D. 1891, between the hours of ten o'clock in the forenoon and five o'clock in the afternoon of said day & shall continue from day to day until said goods, chattels, Etc. are all disposed of at public auction, and, immediately after making said sale, return to the office of the Clerk of this Court a bill of said sale, duly verified as required by law.

And it is further ordered by the Court that said sale be made upon the following terms, viz: Purchasers giving his note with aproved security will be given a credit of nine (9) months without interest, which terms shall be distinctly set forth in all the advertisements of said sale.

It is further ordered that the notice of said sale be given by Posting Four (4) notices in form of the most Public places in said County Three weeks previous to the date of said sale.

It is hereby agreed that if Priscilla Forsyth widow of said Alpha Forsyth shall select articles of personal property as her award out of said Estate and it shall be hereafter determined by any Court having jurisdiction to determine her right to such award, that she is not entitled to such award then the property so selected by her may be sold or otherwise disposed of according to law by the administrators of said estate and her selection of said property and withholding the same from sale shall not operate to her prejudice or render her liable to any charges of waste or mismanagement of said estate provided she shall on the determinators of the question of her right to such award against her. She shall lawfully dispose of such selected property and account for the proceeds thereof as administratrix of said estate

In the County Court of said County. Term 1891

And now came Nancy E. Worrell, Mary A. Lanstrum and Joel Forsyth and represent that they and one William Forsyth are the only heirs at law of Alpha Forsyth and object to the appraisers estimate of the value of the property allowed to the widow filed in the office of the Clerk on the 2nd day of October 1891 and object to the approval of said appraisers estimate by this court and move the court that the same be set asside and disapproved and ask the court by its order to direct the administrators of the estate of said Alpha Forsyth not to pay to Priscilla Forsyth widow of said Alpha Forsyth any widow's award out of said estate for the following reasons to wit:

1st Because that prior to the solemnizing of the Marriage between said Alpha Forsyth since deceased and said Priscilla Forsyth to wit on the 19th day of August 1886 the said Alpha Forsyth and said Priscilla Forsyth (whose name at that time was Priscila Carrier) entered into signed sealed and Executed and antenuptial Contract in and by which Contract the said Priscilla Forsyth in consideration of certain property and money in said contact specified belonging to said Alpha Forsyth & to be or caused by her agreed that she would never claim or attempt to claim any widow's award or any other personal property or any dower or homestead from and out of the estate of said Alpha Forsyth which said contract remains in full force and by reason thereof said widow Priscilla Forsyth is not entitled to any widow's award or any other share or interest in and to the personal estate of said Alpha Forsyth deceased

Now this day come Nancy E Worrell, Mary A. Lanstrum and Joel M Forsyth heirs at law of Alpha Forsyth by their attorneys D Mack & Son and this day comes also Priscilla Forsyth widow of said intestate by her atteorneys O'Harra, Scofield and Hartzell and this day the objections of said heirs to the appraisers estimiate of the value of property allowed to said widow usually called the "widow's award" and their objections to the approval of said estimate and also the mother of said heirs that said estimate be set aside and that the administrators of said estate be directed not to pay any such award out of said estate to said Priscilla Forsyth and the Court having heard the evidence and being fully advised in the [?] finds from the evidences that said Priscilla Forsyth prior to her marriage with the said Alpha Forsyth entered into signed and sealed an antenuptial contract with said Alpha Forsyth wherein and whereby for the consideration of certain real estate and a certain sum of money belonging to said Alpha Forsyth and to be received by her said Priscilla Forsyth that she agreed that she would never claim nor attempt to claim any widow's award or any other share of his personal property or any dower out of the estate of said Alpha Forsyth; and the Court further finds that said Priscilla Forsyth widow as as [sic] aforesaid has received and is in full enjoyment of said real estate and that said heirs have tendered to her this sais sum of money & have ever since kept good said tender and that said antenuptial contract remains in full force and that said widow Priscilla Forsyth is not entitled to any widows award nor any other share or interest in the personal estate of said Alpha Forsyth deceased; It is therefore ordered that said mother be sustained and that said appraisers estimate be set aside and for nought held and the administrators of said estate are directed not to pay or deliver to said Priscilla Forsyth any widows award or any share of the personal estate of said Alpha Forsyth deceased

In the County Court September Term 1892

In the matter of the estate of Alpha Forsyth, deceased.

And now on this day came Priscilla Forsyth and Cornelius B Taylor, administrators of the estate of Alpha Forsyth, deceased, with O'Harra, Scofield & Hartzell their attorneys and presents to the Court for approval their report as administrators of the estate of said deceased showing their acts and doings as such administrators and the money received & paid out by them from the time of their appointment as such administrators to the present time, and come also in person and by their attorneys D. Mack & Son, Nancy E. Worrell and William M. Forsyth two of the heirs of said deceased viz, Mary A. Harper, formerly Mary A. Lanstrum, and Joel M. Forsyth by their attorneys said D. Mack & Son, and the court having inspected said report and having taken the testimony of witnesses examined in open court touching said report and the matters & things therein and concerning said estate and as to who were the heirs of said deceased and having heard the suggestions of counsel and being now fully advised in the premises the Court finds that said report is true and correct and should be approved. The Court further finds that said Nancy E. Worrell and Mary A. Harper (formerly Mary A. Lanstrum) an daughters of said deceased and that said Joel M. Forsyth and William M. Forsyth are grand sons of said deceased, sons of his deceased son, William Forsyth, and that said parties are the only heirs of said deceased.

That said administrators prior to paying to said heirs on their distributive shares of said estate the respective amounts paid to each as shown in said report, exacted and took from each of said heirs a refunding bond in double the amount so paid, conditioned according to law, and the court finds that said distribution as so made was proper and properly made.

The court further finds from the evidence introduced that the attorneys fees of O'Harra, Scofield & Hartzell as shown in said report are proper and reasonable for the work in said estate including final settlement thereof, and that the same were paid, received & accepted in full of all attorneys fees in said estate including final settlement thereof.

The court further finds that all moneys paid out by said administrators as shown in said report were properly paid out and that no objection was made or taken to the administrators receiving the commission mentioned in said report at this time and that no objection is now made to said report or any part thereof.

It is therefore ordered adjudged and decreed by the court that said report and each and every item therein be and the same are hereby approved and confirmed and the acts and doings of said administrators in and about the administration of said estate are approved.

Ordered further that said refunding bonds so taken by said administrators be filed with said report.

In the County Court November Term, A. D. 1893

And now come on this day C. B. Taylor and Priscilla Forsythe, Administrators of said estate, by their Attorneys, O'Harra, Scofield & Hartzell, and comes also Mary A. Harper, formerly Lanstrum, Nancy E. Worrell, Joel M. Forsythe and Wm. M. Forsythe, the heirs of said deceased, by their Attoryneys, D. Mack & Son, and said Administrators now here present to the Court for approval their final report as such administrators and ask to be discharged from further duty in that behalf. And it appearing to the Court that due notice has been given by said administrators to the heirs of said deceased and all other persons interested to the October Term of this Court of their intended settlement of said estate, and the matter having been continued from the October Term to the present term of this Court, and all of the heirs now appearing as aforesaid by their counsel, the Court now has jurisdiction of the person of said heirs and each of them, and there being no objections or exceptions to said report, and the Court having inspected the same, find that the same is true and correct and that the same should be approved and that said heirs by their counsel consent to the approval of the same. And it further appearing to the Court, that the notes inventoried at numbers 1,2,4,6,8,9,18, and 19, and which have not been reported as collected are uncollectable and wholly worthless, and that the same is true as to the balance of the notes inventoried as number 3. That the accounts inventoried and not mentioned in either of the reports as collected are wholly worthless and are uncollectible.

The Court further finds that said administrators have fully administered said estate and properly accounted for all money and property coming into their hands as such administrators; that in and by said report it is shown that there is a balanace of $213.65 remainingin their hands.

The Court further finds that since the prepearation of said report that $9.44 costs were made in said estate upon the claim filed by George Mitchel against said estate, which said administrators have since paid out of said $213.65, -- leaving a net balance in their hands for distribution of $204.25. This the Court finds to be the true and correct balance due the heirs of said deceased and that the same shall be distributed to said heirs.

And now comes said heirs by their counsel here in open Court and receives from said administrators said $204.25, of which sum the said Nancy E. Worrell receives $68.08 & 1/3, and said Mary A. Harper $68.08 & 1/3 and said Joel M. Forsythe and Wm. M. Forsythe each the sum of $34.04 & 1/6, -- which sums the Court finds due them respectively. And said D. Mack & Son for and on behalf of said heirs having executed to said administrators a receipt for the same, the Court finds that, there is no balance now remaining in the hands of said administrators and that all payments made by them out of said estate have been properly made and that estate has been finally settled.

It is therefore ordered that said report be and the same is hereby approved. It is further ordered that, said heirs by their counsel consenting thereto, the notes inventoried at numbers 1,2,3,4,6,8,9,18, and 19 be turned over to D. Mack & Son for collection for the benefit of said heirs, and the same is hereby done.

It is further ordered that said administrators be and they are hereby discharged from any further duty or liability as such administrators, and they and their bounsmen are hereby released from all further liability on their administrators' bond filed herein.
