Owen & Archibald Owen her husband - Bill for partition in the Adams Circuit Court October Term 1852 ? John M Layson, Sarah Pond William Layson Zedekiah M Layson, John Martin Layson, Robert Layson Margaret Moore & James M Moore her husband America Moore & James B Moore her husband, Mary Owen, Samuel Wood & Elisha Worrell the two latter executors of Margaret Layson deceased - Eliza Mustain and Daniel C Mustain her husband Susan Wood & Zachariah Wood her husband Mary J Owen & Archibald Owen her husband plaintiffs with Alpha Forsyth in ? ? named ? being duly sworn depose and say that they never authorized or ?ted or consented that the above named Forsyth or any one else should commence the above named suit in their names and that they have not commenced the same themselves, thus their interests in the ? matter of said suit, is adverse to the claim of the said Forsyth therein, and particularly in this claim, for improvements in said suit - they therefore pray that the said suit may be dismissed in such manner as the facts stated therein may require
