    Whereas the undersigned Isaac Layson, John Layson, Sally Pond, Nancy Owen and Margaret Forsythe as children of John Layson, & whereas the said Sally intermarried with David Pond, the said Nancy with Stephen Owen & the said Margaret with Oliver Forsythe, and whereas the said John the father is very old & infirm & the the [sic] aforesaid children and their husbands are desirous that an equal division of of the land owned & possessed by said John the father should take place between his said children at their said fathers death, it is now understood and agreed between the said children & their said husbands and they do hereby bind themselves, that if the said John the father should leave a will at the time of his death making any devise of said land to them or any of them, that the said will & devise shall be void and of no affect as respects the land aforesaid, and they and each of them do hereby covenant and agree to & with each other to divide the tract of land in Bourbon County, on Stoner, on which said John the father now lives, amongst themselves in the following manner; that is the said Isaac Layson is to own the whole of said tract of land which lies on the north side of Stoner supposed to contain one hundred & two acres according to a survey made by Zachariah Eastin Surveyor of Bourbon April 16'th, 1818 being the whole of said John Laysons preemption on the said north side of Stoner owned by him at this time, but the said Isaac agrees & binds himself to satisfy Robert Layson one of the children of said John for his equal part in his father’s land, by conveying to him half the said land on the north side of Stoner or paying him therefor in money and the said Isaac relinquishes all right & claim to the land on the south side of Stoner to the other children. And the said parties agree that Nancy Owen the wife of said Stephen Owen shall own & have title to the following lot on the south side of Stoner, as her part beginning at an Elm and Hackberry on the bank of Stoner corner to Forsythe thence with his line S. 19 E 135 poles to a stake in Laysons old preemption line, thence with said line S. 87 1/2 E. 66 poles to a stone marked I. L. N.E. corner to said preemption, thence with a line thereof N 23 1/2 west 159 poles to a stake on the Bank of Stoner thence down the creek S. 62 west 40 & one[?] tenth poles to a stake & thence N. 74 west 8 poles to the beginning; And Margaret Forsythe wife of said Oliver shall own & have title to the following lot on the south side of Stoner, beginning at two sycamores & a sugar tree on the north Bank of Stoner corner to David Pond, thence S. 10 degrees E. 100 poles to the middle of the spring, course continued in all 140 poles to a stake in Laysons old line, thence with said line S. 87 1/2 east and 67 poles to a stake, thence north 19 west 135 poles to an elm and Hackberry on the bank of Stoner, thence down the creek as it meanders N 74 W. crossing the creek 22 poles to three Sycamores, corner to Isaac Layson & thence N. 77 1/2 west 26 poles to the beginning; and it is agreed that Sally Pond, wife of David Pond shall own & have title to the following lot on the south side of Stoner, beginning at a stake on the north bank of Stoner, comes to John Layson jr. thence with his line S. 1/2 E. 161 poles crossing Stoner to a stake in Laysons old line and corner to John Layson jr. thence with the old preemption line S. 87 1/2 east 65 poles to a stake, thence N. 10 W. 40 poles to the middle of the Spring, course continued in all 140 poles to two sycamores and a sugar tree on the north bank of Stoner & thence down the creek binding thereon N. 77 1/2 W. ten poles and thence N 53 W. thirty eight poles to the beginning. and it is agreed that John Layson shall own & have title to the following lot of land on the south side of Stoner, beginning at three young sycamores on the bank of Stoner corner to Isaac Layson, thence S. 1/2 degree E. 191 1/2 poles to a Hickory in Laysons old line & corner to his 302 1/4 acres as conveyed to him by Lucas Sullivant by decree of the Bourbon Circuit Court, thence with his line S. 87 1/2 east 44 poles to a stake, thence N. 1/2 W. 161 poles crossing Stoner to the north bank thereof to a stake in Isaac Laysons line, thence down Stoner N. 63 W. 35 poles and thence N 41 W. 20 poles to the beginning. The foundast[?] lots on the south side of Stoner containing east 50 1/8 acres by survey made by Z. Eastin Dec'r 17, 181[9] & Dec'r 20, 1820. And whereas the said John the father is unable to manage his affairs & support himself the parties to this agreement have taken possessio[n] of the respective lots laid off to them aforesaid and agree to continue in the possession & to occupy said lots of land respectively, with care & not to commit any waste or depradation on them, _____ but each of the parties, that occupy the said lots o[f] the south side of Stoner except the one that lives wit[h] & takes care of the father John Layson, shall pay two barrels per acre of corn, that is the plough land, tended by them or one third of the small grain raised on said lots, including the meadow & shall be paid to the person who lives with the father John, for his & his family use, the rent is to cease at the death of the old man & woman their father & mother.

    And whereas the lott assigned to Margaret Forsythe is worth more than the lot to Sally Pond, the said Oliver agrees to pay to David Pond & Sally his wife three hundred dollars at the death of the father & mother of said Sally Pond & the said Oliver and Margaret agree that said lot assigned to them shall be subject to the payment of said three hundred dollars if at the time appointed the money is not punctually paid. It is agreed by & between all the parties that the above division is to stand among them at their fathers death as the only division of said land. It is further agreed that whatever land is cleared on said[?] lots hereafter by any of the parties holding them under this agreement, it shall not be subject to the rent aforesaid, but only the land now cleared. In testimony whereof we have hereunto set our hands & seals this 19'th day of January 1821.

    It is understood that the titles to said land shall be by descent. Jan'y 19'th, 1821.

  • Text: - Heirs Agreement Revisited

    To the Honorable the Judge of the Bourbon Circuit Court in chancery siting your orator John Layson, John B. Raine David W. Pond & Sally, his wife would represent that for many years before the death of John Layson, he was so infirm that he was incapable of transacting his own business. That he owned a tract of 300 acres of land on Stoner about a mile below Paris in Bourbon county, on which he resided until his death. That several of his children were living on different parts of said tract. That the children came to an agreement to divide the land among themselves, they being 6 in number. That for that purpose they on the 16'th of April 1818 got Z. Eastin surveyor of Bourbon county to survey & divide said tract into six equal parts. They make a copy of the platt of survey a part of this bill. That for the purpose of binding the children to said division they on the 19'th of January 1821, with the exception of Robert Layson, entered into a written agreement between themselves among other things, whether said John Layson should die testate or intestate to abide by and stand to said division & to hold the lots respectively assigned them. That Isaac Layson should hold 102 acres lying on the north side of Stoner, on condition of conveying one half thereof to Robert Layson or paying him for the same in money. That the residue of 200 acres was divided among your orator Layson Pond & wife, Stephen Owens & wife & Oliver Forscythe & wife, by metes & bounds giving to each 50 acres & a small fraction. That the lot assigned to Forscythe & wife being more valuable, than the lot assigned to your orator & oratrix David W. & Sally Pond; the said Forscythe bound himself to pay said Pond & wife $300 at the death of said John Layson Sen'r. & his wife & further bound the lot assigned to said Forscythe & wife for its payment, if the money were not paid at the time specified. But for greater certainty they make said agreement a part of this bill.

    They further represent that on the 14'th of June 1821 said Robert Layson by a written instrument at the foot of said agreement signed with his proper hand & name transferred & relinquished all his right and interest in said 102 acres so as afr'd allotted to Isaac Layson, to said Isaac Layson for the consideration of $1000 all of which except $214 he acknowledged to have rec'd. They make said transfer & relinquishment a part of this bill. They charge that said $214 was left by Robert Layson for the use & benefit of his mother, & that Isaac Layson paid & named to be paid the same to his mother.

    They would to represent that said John Layson has departed this life intestate, & that since his death commissioners were appointed by the county court of Bourbon county to allot dower to his widow, who is still living, in said land. That by agreement between her & the children her dower was assigned her not in one intire body, but in the lots so as aforesaid respectively of ____ children. That the report, assigning dower was returned to the county court, approved and recorded. They make a copy of said report a part of this bill. They represent that said John Layson dec'd at his death left the following children & grand children as his only heirs, to wit, your orator John Layson, your oratrix Sally Pond wife of David W. Pond, Nancy Owens wife of Stephen Owens, Margaret Forscythe wife of Oliver Forscythe & Robert Layson, & William, Zedekiah, Margaret Ann, Robert, Martin & America Layson the last six being the children of Isaac Layson dec'd who was a son of said John Layson dec'd, & all infants under the age of 21 years. They would show that although a division has thus been made among the children of said John Layson dec'd and one with which they are all satisfied, yet no mutual conveyances have been made from one to another of them. So that the division is not complete. They charge that said Robert Layson is a non-resident, & the children of Isaac Layson as already shown are infants. They also show that since the death of said John Layson, said Owens & wife by deed bearing date the [blank] day of [blank] in the year [blank] conveyed to your orator Raine the legal title so far as they could of the lot so as aforesaid assigned to them, so that your orator Raine now has the same interest in said 300 acres, which formerly belonged to said Owens & wife. They make said deed which was recorded in the proper office in due time a part of this bill. They would also represent that said Forscythe & wife have conveyed by deed to a certain Charles D. Lennox the lot so assigned them, which deed is of record in the proper office & is made a part of this bill. That said Lennox has paid but a small portion of the purchase money to Forscythe for said lot. That said Lennox will be intitled by his deed to all the interest of said Forscythe & wife in said lot, subject however to the lien of your compl'ts Pond & wife for said $300 on the same or is provided by said agreement. They know not whether said Lennox had notice of said lien before he purchased but believes & ther[efore] charge he had. But whether or not they are advised cannot be material because, he has not paid for the land & because, the foregoing division has never yet been consummated. Your orator would further represent that a certain Elizabeth McClanahan some time since caused a fi [sic] for execution to be issued from the clerks' office of the Bourbon Circuit Court against the estate of your orator Pond, & to be levied by the sheriff upon the lot afr'd assigned to said Pond & wife. And that his said Ponds’ life estate in said lot was sold & your orator John Layson became the purchaser & obtained a deed therefor from the sheriff which together with said execution & return it is made a part of this bill. Your orator pray that said Owens & wife, Forscythe & wife, Robert Layson, said Lennox & the s'd hiers of Isaac Layson be made defendants to this bill [&] that they answer its allegations as fully as if agai[nst] put by way of interrogatory. Being without complete remedy at law & only receivable in equity, they pray a decree confirming the division heretofore made as well as the allotment of dower. They pray also that mutual conveyances among said heirs be decreed & in such manner as to bind the lot assigned to Forscythe & wife either in his or Lennox’ hands for the s'd $300 due your orator Pond & wife & confirming Ponds’ life estate to your orator John Layson. In short, they pray for a decree enforcing specifically the foregoing agreement for a decision. Your orator Raine prays that a conveyance be decreed to him for the lot he purchased from Owens & wife. They pray the comwites'[?] went[?] of spo'd[?] directs[?] It[?] commanding It[?] & such other & further relief as to equity belongs & their case requires & they will ever prayeth.

    The Commonwealth of Kentucky To the Sheriff of Bourbon County Granting: M. Barum[?] and you to summon Stephen Owen and Nancy his wife, Oliver Forsythe and Margaret his wife, Robert Layson, William, Zedekiah, Margaret Ann, Robert, Martin and America Layson, the last six children and Heirs of Isaac Layson deceased, and all Heirs of John Layson deceased, and Charles D. Lennox, to appear before the Judge of our Bourbon circuit court at the courthouse of Paris on the first day of our next August Term to answer a bill in chancery exhibited against them by John Layson, John B. Raine and David W. Pond and Sally his wife. And this they shall in nowise[?] omit under the penalty of 100 pounds. And have then there this writ witness Thomas Arnold clerk of our said court: this 11th day of June 1830 In the 39th year of the Commonwealth.

    The Answer of Robert Layson to a bill in chancery exhibited against him & said others in the Bourbon Circuit court by John Layson & others. This respondent admits a division of their father’s land was made by agreement before his death & that this respondent’s share was allowed to Isaac Layson. He admits that Isaac paid him the purchase money for it except two hundred & fourteen dollars which your respondent left in his hands for the respondent's Mother. He admits Isaac Layson’s heirs are intitled to a conveyance of your orator’s share of said land when the said 214$ are paid. He is willing the division heretofore made between his fathers heirs stand unaltered & that the necessary conveyances be made. He consents, to commissioner or commissioners be appointed to make conveyances such as may be necessary. He prays, the court to decree in the case as speedily as possible. Having answered every thing decreed material he unites with complaintant in praying a consummation of said divisions by mutual conveyances.

  • Text: - Charles D. Lennox Affidavit

    The answer of Charles D. Lennox to a Bill of Complaint exhibited against him and others in the Bourbon Circuit Court by John Layson and others.

    This respondent preserving &c for answer therein states that true it is the defendants Oliver Forsythe and Margaret his wife sold and conveyed to him by deed of bargain and sale, their interest in the tract of land in the Bill mentioned and for the consideration in said deed dated; and by his tenant, this defendant is now in the possession of the lot assigned, to said Oliver & Margaret by said article of agreement referred to in the complainants' Bill. and he will make a part of this answer the deed from Oliver and Margaret to him and will hereafter file it. He states that when said deed was executed to him he had not heard of the lien created on said lot in favor of David W. Pond & Sally his wife, for the amount of three hundred dollars as provided for in said article.

    He states that said Margaret Layson the widow of John Layson deceased, the ancestor of the said Margaret Forsythe is still alive. He admits that when he received said deed from said Oliver & Margaret he had heard from said Oliver that the children of said decedent John Layson had laid off said land into lots and had assigned to said Oliver and Margaret the lot which this defendant has now in possession by his tenant as aforesaid. but the terms and conditions of said division this defendant did not then know and of course was ignorant of the lien on said land in favor of said Pond & wife for said $300.

    He wishes that by the decree of this Court herein his interest in said land may be allotted, to him to hold in severalty or that a several title in said lott may be assigned to him by the appropriate deed.

    And if said lot on this def'ts' interest in said land should be charged with said $300, then he prays that he may have a credit against said Pond and wife for the value of the corn & other products which said Pond and wife owe to said Oliver by reason of his having kept and onffected[?] said decedent John Layson & Margaret his wife, once the execution of said article, for the term of eight years or thereabouts. that by said article the said Pond & wife were bound to pay to said Oliver during said term, two barrels of corn per acre annually for the plowland in said lot by said article assigned to said Pond & his wife. and also one third of the small grain & hay raised on said lot during the same time, neither of which had said Pond or his wife ever paid to said Forsythe. and the value of said corn and small grain this defendant prays a credit for against said $300. if the payment which[?] shall be enforced against this defendant by way of a lien on said land.

    He has no knowledge of the other allegations in said Bill further than he has above ammeded to and admitted except that he believes that the names of the children of said decedent John Layson are correctly set forth: but he does not know who are the children of Isaac Layson deceased and who was one of the sons of Old John Layson under[?] when the Complanants claim.

    He states that said Oliver Forsythe occupies said lot of land; assigned to him and his wife by said article, under this defendant and as his tenant and having answered said Bill he prays to be hence indemnified[?] &c.

    He charges that there were about twelve or thirteen acres of plow land on said lot assigned to said Pond & wife and about six acres of other cleared land which was generally sewn in small grain or used as meadow, while said John Layson and wife lived with the said Oliver as aforesaid

    Bourbon County Pet. This day Charles D Lennox made oath before me a Justice of the Peace for said County that the statements contained in the within answer are true to the best of his knowledge and belief given under my hand this 8'th day of November 1830.

    The answer of Oliver Forsythe to a Bill of complaint defending against him and others in the Bourbon Circuit Court by John Layson & others

    The defendant reserving &c for answer states that he is apprised of the answer filed herein by his codefendant Charles Lennox and acquainted with its contents and he adopts said answer as the answer of him this defendant. and he prays that the Complainant Pond sen'r[?] & said Sally may be decreed to pay the rent therein mentioned as due from them to this defendant for keeping John Layson & wife, agreably to the stipulations of the article of agreement. and he prays to be hence dismissed with his costs &c.

    The answer of Wm Layson for himself and the answer of Zedekiah, Margaret Ann, Martin, Rob't & America Layson by said W'm Layson their special guardian to a bill in Chancery exhibited ag't them H by John Layson H in the Bourbon Circuit Court. These respondents admit they are the children of Isaac Layson dec'd. Your respondent W'm Layson says he is now over 21 years of age. These respondents admit they believe the allegations of compl'ts' bill are true. They are willing a conveyance be decreed as prayed for. They claim a conveyance for the 102 acres held by their father at his death. They pray their interest be protected by the court.

    This day W'm Layson made oath before me a justice of the peace in & for said county that the facts in the foregoing answer are true so far as he knows & believes. Given under my hand this 20'th Augt 1831

  • Text: - Heirs Agreement Confirmation

    This cause this day came on to be heard upon the bill & answer of Lennox, Rob’t Layson, the heirs of Isaac Layson dec'd, & Oliver Forscythe, & the exhibits. And it it appearing process has been duly executed on Owens & wife & Margaret Forscythe and they having failed to answer complts' bill, it is decreed that its allegations ag't them be taken as true. The court confirms the contract of division made among the heirs of John Layson dated January 19, 1821 & which is filed in this case. It appears that Owen & wife have sold and conveyed the lot set apart to them in that division to John B. Raine. It appears that also that compl't John Layson purchased under execution the life interest of David W. Pond in the lot assigned to Pond & wife in that division. It appears that Forscythe & wife were to pay Pond & wife $300 at the death of the widow of John Layson dec'd the difference ni [sic] the value of their respective lots & that said sum should attach as a lien on the lot of Forscythe & wife, if said money should not be paid at the death of said widow. The def't Lennox has purchased said lot from Forscythe & wife & got a deed therefor. But his title not being complete & he being a purchaser with notice of said lien, it is decreed that the lien attach to said land in his hands. It is now decreed that the heirs of John Layson do make mutual conveyances to each other for the lot so assigned to each other by deed with special warranty on or before the first day of the next term of this court. They are to convey to the heirs of Isaac Layson dec'd the one hundred & two acres lying on the north side of Stoner. They are to convey to Raine the lot he purchased from Owens & wife. To Lennox the lot he purchased from Forscythe & wife & are to specify in it the lien afs'd of $300 to be paid at the death of said widow. They are to convey to Pond & wife the lot assigned them but must specify that it is to be held and enjoyed by John Layson by virtue of his purchase under said execution during the coventure of Pond & wife & during the life of Pond should he be the longest lives provided it shall appear that he had any children by his wife born alive. The conveyances to be made agreeably to the boundaries specified in said contract of division & the platt of survey referred to in complaintants' bill. In case said conveyances shall not be made by the time above directed then & in that case Thomas Elliot Esq shall be & is hereby appointed a commissioner on behalf of said heirs to make the deeds aforesaid in the manner already directed. The costs of this suit to be borne by the parties equally or among themselves. Where there are fences[?] covert[?] the heirs of John Layson dec'd the conveyance is to be made to the fence[?] alone.
