  • Text: Last Will and Testament of Daniel Witt Deceased

    I. Daniel Witt Sr. in the County of Adams and State of Illinois do hereby make and declare this my last will and Testament in manner and form following to wit,

    First. It is my will that my funeral expenses and all my just debts be fully paid.

    Second. I give devise and bequeath unto my beloved wife Martha Witt the farm on which we now reside situate in said County and known and described as the West half of the South West Quarter of Section No. (30) thirty in Township No. (2) two North of Range No. (6) Six West of the forth principal medidian Eighty Acres also Ten Acres off of the South West corner of the North West Quarter of Section '30 "2 N. of R. C W. during her natural life and at her death the above described lands to my son George W. Witt and his heirs and assigns forever.

    Third. After the payment of Such funeral expenses and debts I give devise unto my said wife and all my children the remainder of my goods and chattels to be divided at the death of my said wife.

    And lastly, I hereby constitute and appoint William Riley of this my last will and Testament ratifying and confirming this and no other to be my last will and testament.

    In witness thereof I the said Daniel Witt have hereunto Set my hand and Seal this the 16th day of November A. D. 1852.

    Signed Sealed published and declared by the said Daniel Witt as and for his last will and testament in presents of us, who in his presents and in the presents of each other and at his request have subscribed our names as Witnesses thereto

  • Text: Bond of William Riley, William Nelson & Ezekial Walters Exr of the Est of Daniel Witt

    Know all men by these Present that we William Riley and William Nelson, and Ezekial Walters of the County of Adams and State of Illinois, are held and firmly bound unto the People of the State of Illinois in the penal sum of Twenty five hundred dollars current money of the United states which Payment will and truly to be made and Performed. we, and Each of us bind ourselves, our heirs, Executors and Administrators Jointly Severally and firmly by these Presents: Witness our hands and Seals this fourteenth dy of June AD 1855; The Condition of the above obligation is such, that if the above bounden William Riley, Executor of the last will and testament of Daniel Witt; Deceased do make or cause to be made a true and perfect Inventory of all and Singular the goods and chattels Righets and Credits lands tentaments and hereditaments, and the Rents and proffits issuing out of the Same of the Said William Riley or into the Possession of any other person for him and the Same So made do exhibit in the County Court for the Said County of Adams as required by law; and allso make and Render a fair and Just account of his acting and doings as Such Executor to Said Court when thereunto Lawfully Required; and to well and truly fullfill the duties enjoined on him in and by the Said will and Shall moreover pay and deliver to the Person entitled thereto all the Legacies and bequests Contained in Said will so far as the Estate of the said testator will thereunto Extend according to the value thereof and as the law Shall charge him; and Shall in general do all other acts which may from time to time be required of him by law then this obligation to be void otherwise to Remain in full force and virtue

    The People of the State of Illinois

    To all to Whom these presents Shall come Greeting
    Know ye whereas Daniel Witt late of Adams County and State of Illinois died on or about the Eighth day of May AD 1855 as it is Said after having duly made and published his last will and testament a copy whereof is hereunto annexed, leaving at the time of his death property in this State which may be lost or destroyed or diminished in value, if Speedy be not taken of the Same and inasmuch as it appears that William Riley has been appointed Executor in and by the last will and testament to Execute the Same and to the End that the Said property may be preserved for those who Shall appear to have alegal Right or interest therein; and that Said will amy be Executed according to the Request of Said Testator we do hereby authorize the said William Riley as such Executor to collect and Secure all and singular the goods and Chattles rights and credits which were of the said Daniel Witt at the time of his decease in whosoever's hands or Possession the Same may be found in this State and will and truly to perform and fulfill all Such duties as may be enjoined upon him by the Said Will So far as these Shall be property and the law charge and in general to do and perform all other which are now or thereafter may be required by law
