The Commonwealth of Virginia to the Sheriff of Henry County Greeting We Command you to Summon Nancy Brewer widow and relict of William Brewer dec'd and ? of said Brewer John Dillard Guardian ? ? of Martha W Brewer, Matilda M Brewer, Lucy Brewer, Samuel Brewer, Lorenzo Dow Brewer, Sarah Brewer, Catharine, Wm Patterson Brewer and Jno Brewer to appear before our Justices in Chancery of our said County Court at the Courthouse On the first day of Our March quarterly term to answer a Bill in Chancery upheld against them in our said Court by Thomas Nichols and this they shall in no ? ? under the penalty of L100 cash and have them thus ? ? ? ? Clerk of Our Said courts at the ? the 17 day of February 1815 and in the 39th year of the Comonwealth.

provided a good and lawful Right and Title to the said land shall be made to hom in conformity to the terms of the afores'd agreement, which for greater certainty be ? the said John Dillard junior may be ? to Jno's ? to the ? to the end that it may be made a part of this his bill when pro?
That your orator is advised that no such right can be made by the said ? ?, nor anyone else the said William Brewer having departed this life intestate before by the terms of his agreement he was bound to convey the said land to ? orator, without having made a deed or any other conveyence for the same

To the end therefore that a specific performance of the said agreement may be decreed, your orator prays that the said Nancy Brewer widow and relict and administrator of the said William Brewer the said infant heirs of the said William by their guardian John Dillard be made parties defendants to this his bill be compelled to answer the allegations therein contained as fully as if they were again thereto specifically interno: ?.
That the commonwealth subpena in chancery be awarded him: matters of this ? being coequitable only in courts of equity.
That a specific performance of the said aggreement be decreed in conformity to the terms of the said agreement, as to the purchse and sale of the land and that, the defendants be ? to receive payment in Bank notes agreeably to the verbal

To the worshipful court of Henry County in Chancery ? honorably complaining ? to ? worships your orator Thoms Nichols.
That on the _____ day of _____ in the year 1814 your orator entereth, into an agreement in writing with a certain Williams Brewer since deceased for the purchase of a tract or parcel of land containing one hundred and thirty five acres lying ? Hosepasture Neck and a branch thereof, being the same purchased by said Brewer of P. R. Gilman and bounded as follows to wit beginning
That the said agreement is in the possession of John Dillard Junior
That the said Brewer departed this life on the _____ day of _____ 1814 having, Nancy Brewer his widow who has since qualified as administrator of all the goods and chattels rights and credits of the said William, and his children and heirs under the age of twenty one years
That John Dillard has been admitted and appointed by this worshipful court guardian to defend this ? for all the afores'd children and heirs of the said William Brewer
That by the terms of said agreement your orator was to pay to the said William Brewer the sum of eleven hundred dollars on the 15th day of February 1815.
That it was verbally stipulated and agreed between the said Brewer and your orator that the said sum of eleven hundred dollars should be payable in Bank notes.
That your orator was on the 1st day of February and has ever since been and still is ready to pay the said sum of $1100 to any ? authorized to receive the same.

The Answer of Nancy Brewer widow and administratrix of William Brewer Dec'd to a Bill of Complaint exhibited against her and John Dillard Jnr Guardian for the infant heirs of th said William Brewer Dec'd for Answer thereto or so much thereof as she is abvesid it is material for her to Answer ? and says
That it appears from an agreement filed in this court that there was an agreement to sell the land mentioned in the said complaintaint's bill to the said Nichols in case he should pay the said William Brewer Dec'd the sum of $1099 Dollars on the first day of February 1815 which sum the said Nichols ? not pay ? ? ? according to the agreement ? paid or tendered either in ? or ? and as to the agrreement to take ? ? ? knowledge and ? ? ... ? ? and she further states that that she never ? to relinquish her dower in the lands of which the said William Brewer dec'd signed and having fully answered prays to be hence dismissed with her costs and as in ?

The ? of John Dillard Jr their guardian to a bill of Complaint exhibited by Thomas Nichols in this worshipfull court against Nancy Brewer widow and aministratrix of William Brewer Dec'd and John Dillard Jnr guardian for _____ children and Heirs of the aforesaid Wm Brewer Dec'd for answer thereto or somuch thereof as he is advised it is material for him to answer, answer and says -
That he knows nothing of the agreement of William Brewer to sell his land to Thomas Nichols further than appears from the ? of the agreement mentioned in the complaintaint's bill and acting as guardian for the above named infant heirs says that the father of s'd children did ? the time mentioned for the payment of the money and that the complaintant has never tendered any money of notes to him nor to any other person as ? as he knows and having fully answered prays to be hence dismissed with their costs and as in ?

Articles of agreement made and intered into this 19th day of October 1814 Between William Brewer of the one part of County of Henry & State of Virginia and Thomas Nichols of the County aforesaid - witnesseth that the same William Brewer hath bargained and sold unto Thomas Nichols the whole of the tract of land on which he now lives with all it houses, fences and appurtences watsoever - for and in consideration of which the said Nichols obliges himself to pay to the said Brewer one thousand & ninety nine dollars in cash on or before the first day of February 1815 - In consideration of which the said Brewer obliges himself he heirs executors and or assigns to convey to the said Tho's Nichols his heirs &c on or before the first day of Feb'y 1815, a lawfull fee simple right and title to the above mentioned tract of land - the said Brewer is to have the privledge of the houses and firewood until the first day of April next at which time he is to give possession - In witness whereof we have hereunto set our hands and affixed our seals this 19th day of October 1814
