  • Text: WILL OF PHOEBE JANE HUMPHREY

    I, Phoebe Jane Humphrey, of the City of Galesburg, Knox County, Illinois, being of sound and disposing mind and memory, do hereby make, publish and declare this to be my last Will and Testament, hereby revoking any and all Wills by me heretofore made.

    FIRST: I direct that my executor, hereinafter named, pay all my just debts and funeral expenses as soon after my decease as conveniently made.

    SECOND: Subject only to the payment of such debts and funeral expenses, I hereby give, devise and bequeath to my said executoer all of the property, both real and personal and wheresoever situated of which I may die seized and processed, in trust however for division and distribution in manner following: That he first pay to Mrs. Lavina Jane Lindsey, now of Index, Washington, the sum of Three Hundred Dollars ($300.00); that he then divide all the remaining balance, share and share alike, among my three children Artie Randolph Humphrey, Herschel Wayne Humphrey, and Minnie Elizabeth Forsythe. In case of the death of any of my said children prior to my decease, then the share of any deceased child shall be paid to the persons or persons who may, at the time of my decease, be the legal heir or heirs of such deceased child.

    THIRD: I nominate and appoint my son Herschel Wayne Humphrey as executor of this my last Will and Testament and direct that he be not required to furnish any bond as such

    executor. I give to him as such executor full power to sell and convey real and personal property, to execute and acknowledge deeds of conveyance and to do any and all other acts or things necessary or proper to carry into effect the provisions of this Will.

    In Witness Whereof, I have hereunto set my hand and seal this Twentieth day of August, A. D. 1929.

    The foregoing instrument, consisting of two pages and signed by the testatrix on each page thereof, was on the day of the date thereof signed, sealed, published and declared by the said Phoebe Jane Humphrey as and for her last Will and Testament in the presence of us, who, at her request and in her presence, and in the presence of us, who, at her request and in her presence, and in the presence of each other, do hereunto subscribe our names as witnesses and we certify that the said Phoebe Jane Humphrey is, in our opinion, on said date of sound mind and memory.
