    Richd McAlister's Ests.
    to
    Isaac Forsyth -

    This Indenture Made the Seventeenth day of July in the Year of our Lord One thousand seven hundred and ninety eight Between Archibald McAlister, Jesse McAlister and Jacob Rudisell Executors of Richard McAlister Esquire late of the Town of Hanover in the County of York and State of Pennsylvania of the one part And Isaac Forsyth of the Town, County, and State aforesaid of the Other part, Whereas Thomas Lilly Esquire in and by a certain Indenture duly and fully executes under his Name and Seal bearing date the fourth day of November in the Year of our Lord one thousand seven hundred and Seventry eight, reciting as therein is at large recited and for the Consideration therein contained did grant, bargin Sell and confirm onto the said Richard McAlister and to his Heirs and Assigns forever, A Certain Tract of Land, situated lying and being in Heidelberg Township in the County of York aforesaid by Metes and Bounds in the said recited Indenture particularly Specified, Containing Three Hundred and seven acres Neat? measured being part of a larger Tract of Land called Diggs's Choice, as in and by the said in part recited Indenture Recorded in the Office for Recording of Deeds in and for the County of York Book E. E. Page 302 ?. Reference thereto being had may more fully appear And Whereas the said Richard McAlister being so seized and possessed yet in part of the said above mentioned Tract off Land and Premises in his demise as of fee, died having first made and published his last Will and Testament in Writing being date the twenty sixrh day of September in the year of our Lord One thousand seven hundred and ninety five Wherein and whereby did Order Impower and Direct his Executors therein named to sell and dispose of all his Real Estate in the County of York ?, either in Lots or in whole by public or private Sale, and therein did Nominate and appoint the said Archibald McAlister, Jesse McAlister, and Jacob Rudisel Executors thereof, as in and by the said last Will and Testament since his decease duly proven and remaining in the Registers Office at York Referance thereto being had may more fully appear, And Whereas the said Archibald McAlister, Jesse McAlister, and Jacob Rudisel Executors of the last Will & Testament aforesaid in pursuance of the directions of the said recited Will, did on the thirs day of April 1797: Expose to Sale the said deceaseds Real Estate aforesaid in Lots, by way of public sale after havnig given due and legal Notice of the day and time of Sale and then and there did sell two Certain Lots of Ground being a part of the within described Tract of Land Containing in the one Six acres and thirty five perches of Land and in the other Five acres and one perch as the same will herein after be more particularly describe unto the said Isaac Forsyth for the sum of Two hundred and seventy pounds thirteen shillings and nine pence, Lawful money of Pennsylvania which being the highest and best price bidder for the same. Now this Indenture Witnesseth that the said last Will and Testament aforesaid for and in Consideration of the said sum of Two hundred and seventy pounds thirteen shillings and nine pence lawful money aforesaid to them in hand paid by the said Isaac Forsyth at and before this sealing and delivery of these presents, the Receipt and mayment whereof is hereby acknowledged, Have granted bargained sold released and confirmed, and by these presents So grant bargain Sell release and confirm unto the said Isaac Forsyth his Heirs and Assigns All that the said Certain two lots of pieces if Ground above mentioned Situated lying and being in Heidelberg Township aforesaid whithin the several Courses and distances to each of the said two Lots particularly belonging, as follows Vizt. the one Beginning at a post on the Baltimore Road, thence with the same South forty degrees East nineteen perches to a post for a Corner of Richard Seabrook's Lot, Thence with the Same South fifty two and a quarter degrees West fifty four perches to a post in the line of William Gitts Lots thence with the same North thirty one degrees West nineteen perches and two tenths to a post for a Corner of a Lot of John McAlister of Orm?, thence with the same North fifty two and a quarter degrees East fifty one perches to the place of Begining, Containing Siz acres and thirty five perches of Land Strict measure, and the one other Lot Begining at a post on the York Road thence outh seventy one degrees East twenty perches to a post for a Corner of Jacob Herreter's Lot thence with the same South twenty and a quarter degrees West forty three perches & eight tenths to a post for a Corner of Jacob Shurps Lot, thence with the same North fifty six and a half degrees West twenty two perches and three tenths to a post for a Corner of one Other Lot og Jacob Shurp, thence with the same North eighteen and three quarter degrees East thirty eight perches and nine tenths to the place of Begining, Containing Five acres and one perch Strict measure, Together with all and singular the Improvements thereon and on each of the said two Lots of Ground erected and being and all ways Wooos? Waters, Water Courses Hedges Ditches Trees Fences Profits Priviledges Advantages Emoluments Hereditaments and Appurtenances thereto belonging or in any use? appertaining, and lying and being within the Bounds and Limits of the said two Tracts of Gound, and the Reversion and Remainder, Rents Issues and Profits thereof and all the Estate Right, Title, Claim, Property Interest and Demand whatsoever of him the said Richard McAlister at and immediately before the time of his decease either at Law of Equity of in and to the same or any part thereof To Have and to Hold the said two lots or Peices of Ground Heredaments & Premises herby granted or intended so to be with the appurtenances unto the said Isac Forsyth his Heirs and assigns To the only proper use benefit and behalf of him the said Isaac Forsyth his Heirs and assigns forever, And the said Archibald McAlister, Jesse McAlister and Jacob Rudisel - Executors of the last Will and Testament aforesaid do hereby for themselves their Executors and Administrators Covenant promise grant and agree to and with the said Isaac Fosyth his Heirs and Assigns That is to say that they the said Executors have not at any time or times heretofore Wittingly or Willingly done or suffered any act, matter Cause, or Thing whatsoever whereby the said hereby granted premises or any part thereof is or may be incumbered or impeached in Title Charge Estate or otherwise howsoever In Witness where of the said parties have hereunto set their Hands and Seals dated the Day and Year first above Written.

    Received on the day of the date of the within written Indenture of and from the within named Isaac Forsyth, the sum of Twp hindred and Seventy pounds thirteen Shillings and nine pence lawful money of Pennsylvania in full of the Consideration money within the mentioned to be paid -
