    By Virtue of the Authority derived unto me I doe hereby In the Kings name Constitute Appoint & Authorize you William Darvall Luke Wattson Norton Claypoole John Roades Edward Southrin Robert Hart and John Kiphaven to be Justices of the Peace in Jurisdiction of the County of the Whore Kills which my will pleasure is shall from hence forth be Called by the name of the Extent whereof shall be from the maine branch of Creek Called the three Runs northwards; And southwards to Asewomet Inlet; Reputed And Accounted Cape Henlopen which Cape Henlopen I will from hence forward have Called by the of Cape James; And you or any four of you to be a Court of Judicature; Giving you & Every of you full power to Act in the office According to Law and the Trust Reposed in you; of which persons are to take notice and to give you the due Respect and obedience Belonging to your places in the discharging of your duties Comission to be of force for the space of one year After the date or untill further order Given under my hand and seal at the 25th day of the 10 mo; 1682; Being the second year of my Government.

    Item I give and bequeath unto John Depree & his Son Jacob Depree the other half of my Land & Plantation if it please God that I dye without Issue or Wife that is to say to them or their heirs for Ever never to be sould but to continue from Heir to heir for Ever & if the said John Depree should dye now or before his Son Jacob comes to age then it is my Will that Andrew Depree shall keep this Moiety of Land in his Possession untill the sd Jacob Depree doth come of Perfect Age & then to deliver the sd Jacob Depree possession of this said Moiety of Land.

    An Action of ye Case upon Atachment. Hermanus Willtbanck Plant, The Estate of Wm. Beverly Deft. The Plant declares for Seaventeen Pounds thirteen Shil Nine Pence due upon Accounts the last Court the Deft Petiti. for a Refferance till this Court by reason that his prinsipal Evidence Henery Strecher who hath all his Writeings & Accounts are gon up the River & other of his evidences are not here which was granted till this Court, after much is put on both sides and many Objections against the said Account the Court advised them to refer it to men & accordingly the Plaintiff nominated Norton Claypoole the Defts chose Wm. Emmit & they doe declare in open Court that they doe refer all differences that are betwen them to the sd William & Norton giving them full power (if they cannot agree the said differences by or before the 20th day of this Instant) to chuse an Umpire to end & deter min the sd differences & they doe promiss to Forfeit One Hundred Pounds if either of them refuseth to stand to the Award or determination of the said persons Nominated & Chosen or the Umpire which shall be chosen by the sd Norton & William.

    A PROTEST MADE BY BENJAMIN BLAGG MR of the SHIP SOC[IETY] AGST THE DETAINMENT of A PARCELL of OYLE & WHALE BON[E]

    Sussex County belonging to the Province of Pennsillvania
    Whereas the Ship Society belonging to the ffree society of traders of Pennsillvania is Expressly ordered & sent to [the] Roade within Cape James on purpose to take in & loade [A] parcell of oyle & Whalebone belonging to & upon accoun[t of] the ffree society aforesaid, Benjamin Blagge being Mr of [the] said ship for this present voyage, have this day deman[ded] of John Hill the said oyle & Whalebone which should ha[ve] bene delivered to him by vertue of an order or Comition fr[om] the society aforesaid, for his receiving the same the ship ly[ing] ready in the road aforesaid, for the convenient loading the sam[e] the Answer that is given me by the said John Hill is that part of the said oyle is converted by one Henry Bowman t[o] his owne use & the rest thereof is Attaiched by the said John Hill by law as allsoe the Whalebone for the societys use and Cannot have an Issue thereof in Court untill the 11th or 1[2th] day of the next Month Called June ffor which causes I Benjamin Blagg Mr of the Ship aforesaid doe here prote[st] against the detainment thereof & shall God willing proce[ed] on oure Intended voyage with oure said Ship Society According to order, This protest is made at the towne of Lewis in the County aforesaid this 3 day of ye 3 Month call[ed] May 1684 by me Benjamin Blagge in Wittness whereof I have hereunto sett my hand the Day & yeare before writte[n] with the seale of the County aforesaid;

    October 4th, 5th, 6th, 1687.

    Johnathan Baily being called to tryall & the petty Jury called for and aboute to be called over Mr. Wm. Clarke president being absent when the Grand Jury brought in ye sd Inditement but now being upon the bench told the Court there would be noe Need of A Jury for this buisness for to his Knowledge there was A petition delivered to the Councell aboute it and the Councell had ordered Something in it, & how it should come ffrom the Councell to be tryed in this Court he did not know, Norton Claypoole Answered that presidt Clarke told him & ffrancis Cornwall yt the petition which presidt Loyd delivered to ye Councell aboute the burying Ground &ct was slighted by the Councell for as much as it was not directed to them, for Indeed ye petition was directed onely to presidt Loyd when he was here hoping and believing that he would order wee should have the use of oure Antient burying ground as formerly and he told us when wee delivered ye petition that if he stayed long enough viz 3 or 4 days longer he would call A Court and have it done before he went if not ye law was open to us & told us how to proceed Presidt Clarke told the Court if they thought fitt to goe on with it he would goe off the bench ye Jury being called over before the inditement was Read presidt Clark sent for Justice Wynn off the bench and there being but three Justices left proceedings was stopt whilest Justice Wynne came againe then came Johnathan Baily with Justice Wynn & promised before the Court that he would consent that one Acor of Land to be laid oute in the same place where ye burying ground hath bene used, which gave some sattisfaction to ye Court and Country; and as for the Hye way The Court ordered that the same should be as wyde before ye said Johnathans Land as before other peoples howses in the towne Whereupon further proceedings was stopped Justice Wynn signed the said order in the dockett booke.

    The Grand Jury brought in further presentments as viz, * * * We doe Request the Court forthwith to order A Court house & A prison to be provided according to Law that the Inhabitants may not be sufferers the 4th 8 mo: 87.

    Norton Claypoole in open Court Delivered three Matchcoats to Christian the Indian Sacamacko for the Indian Right and title of one thousand Acors of Land scittuate in Kent County on this side Dover Rivor aboute three miles from the place that Dover towne is Intended to be built and he the said Christian the Indian did then Acknowledge to have sold given and Granted the Indian Right title and Interest of the sd land being one thousand Acors according to the survey and pattent thereof from him his Heirs &c promising to defend the said Norton Claypoole from the lawfull claim of any other Indian Claiming any Right title or Interest of or to any part of the said land in Wittness Where of he the said Christian have hereunto set his hand and seale the day and yeare first above Written.
